HOW TO CLAIM COMPENSATION AS PER RERA ON DELAYED POSSESSION

I have booked a flat in emaar mgf in 2013 and it was to get delivered in 2016 but till now its not delivered and expected date is dec 2019 if builder is not giving compensation as per RERA what should i do

You'll have to check as to when did the project get all approvals from the government because most agreements from Emaar mention that possession will be given months after all approvals have been received. before you proceed to file RERA complaint before the Gurgaon authority, you must first be sure as to when the approvals were received and accordingly file a complaint in RERA. Now RERA Gurgaon consists of both authority and Tribunal so your dispute will be heard effectively.

We deal with the same. Prima facie, you have a direct cause of action. There are multiple remedies available depending upon the fact as to whether you want to withdraw from the project or not. Happy to help.

Hi,it is advisable to file a complaint under section eighteen of RERA ,for seeking delayed interest till possession..As per section 18 of RERA ,incase the builder fails to provide possession within terms of the builder buyer agreement,the allottee can seek delayed interest till possession from the developer
