Police won't accept the complaint (although they should). Police generally try to stay away from issues which are of civil nature. You can always make a complaint to RERA and ask for refund. However, if you have spoken with police and they are ready to accept the complaint then you can file complaint to police after consulting a lawyer.

Dear sir
For this firstly you have to send one legal notice to the builder if he fails to rply that notice or not complied with said notice then you can proceed legally against the builder , you have 3 legal option if company insolvency petition filled before NCLT mumbai bench then you can approach there and file your claim , second option you can file consumer complaint before consumer court

you will have to file an appeal either by yourself or through an Advocate practising in the Bombay High Court.
if you wish to file the appeal all by yourself and appear as party in person you will be mandated to provide sort of an examination with the registrar of the court to satisfy that you are aware about the procedures of the court and that you understand court etiquettes.

Dear Sir,

You can file a complaint for non registration of the project before the RERA Authority.
You can seek refund and penalty on the Developer for delay in giving you possession.
You can also file a Consumer Consumer Complaint before appropriate forum.
Regards,
Adv. Shrikant Bagade
