1st try for bail , once he is out of bail then you can only first priority to get a bail , if bail is rejected from the trial court , then approach the higher court , thereafter you can think about further steps till now you can only think about bail

Q: Extra marital affair and adultery by wife

Hi, my wife has extra marital affair and involved in adultery with her office friend. I have proofs for it like Instagram chats, audio call recordings, call history, gps location, hotel bookings, bank statements, her phone and few photos of both of them. I wanted to check if this proof is sufficient to prove extra marital affair and adultery. Also want to check if courts can grant divorce based on extra marital affair if I am unable to prove adultery in the court.

Advocate Manindra Pandey answered
yes if you can prove the adultery then the court will grant a divorceand it's my suggestion to kindly file divorce case as soon as possible otherwise your wife has the right to sue for maintenance and domestic violence

Q: Husband Cheating and need legal advice

My husband is very loyal and decent . Recently I saw some incidents where he and his colleague were very close and intimate. I went into mental trauma. I wanted to change him and live together. But I feel nothing works. We have a daughter and son above 15 years. Need advice on this.

Advocate Manindra Pandey answered
You can go for divorce if you think there is nothing to be changed so a better option is a divorce but proving adultery is very hard before the court of law so kindly collect proper evidence to pursue your case
