I'm an NRI, in June 2019 my school mate contacted me after 10 years and needed help with funds on the pretext of his father being in hospital. I sent him 500$ USD to INR through Xoom. Then again he contacted me for another reason and sent him another 200$ and again another transaction of 200$. A total of 900$, the forth time he asked I suspected and didn't send him and ever since I have been asking him money and he is evading and making false promises and did not even send me a dime back. He blocked me on whatzapp few months ago and today blocked me on social media. As per latest conversation he was supposed to send me money by this month end, and since he blocked me I know that is not going to happenI want to file a case of cheating against him, I have all transaction reports whatzapp chats and facebook chats to prove he did not return any money. Can I file a case against him of cheating as an NRI. Thank you

First of all you must serve him a legal notice and in that notice you can write either refund my money back along with compensation or face legal action. That’s the easiest way to get back your money back. And just keep all the transaction details in safe custody. For more legal assistance I am just a call away.

Yes you get your complaint drafted by an advocate and forward the same to NRI cell ! The wrong gain n wrongful loss are the ingredients of your case ! Though u can also file recovery suit via your advocate! But it will take time

There is no limitation which can stop a NRI to file the complaint. However, on invoking the criminal jurisdiction, the police or the court may ask you to appear before them to assist in investigation. For those issues, you must be ready.

Another remedy is to file civil suit for recovery of money from your friend. In that suit, you can recover the money along with the interest from your friend.
