Want to purchase property owner only have share certificate

Owner is a first owner, 40 years back there was a procedure for first forming society then issuing the flat so the owner is having only the share certificate and no other chain of documents. Can i purchase the flat and what are the procedures? I am hindu

Sirji. U have to demand the property extract from the owner. And ask all the documents relating to the flat. If it is society and in the proceeding of having a provision of change membership and the whole building is in the name of socity then u have to go to the advocate and show him documents. Without inspection of documents it is very hard for opinion

This is my response to you:
1. There should be some sale deed with the builder?
2. There should be some other document especially allotment letter or some document transferring the title;
3. If it is not there then maybe it can be found at the Registrar's office?
4. File an RTI and try to find a source of other documents or the whereabouts of the builder;
5. Ask the original owner to file a suit for declaration of right, title and interest on the property and claim ownership;
6. Once he does then he can transfer the same to you.
