validity of genaral power of attorney after death of principal & agent

My grand father was allotted a land in a society in delhi in 1980. He constructed ground floor on it . He entered into a Genaral power of attorney with his brother for a consideration of Rs. 1 lack and he gave his brother the right to construct 1st floor over ground floor to his brother. His brother constructed 1 st floor out of his own funds. My Grand father's brother did not registered the GPA in his name. My grand father retained the roof right to himself only. As on date both the parties to GPA are not alive. but the 1 st floor is still in the possession of my grand father's brother family. I want to know today about the validity of GPA entered between the parties that are both dead. How can we vacant the 1 st floor from illegal possession of my grand father's brother's family.

General Power of attorney signed and executed by the parties for a period since 1980 can not be termed a illegal. Also if the property was a self acquired property of your grandfather then your father had share in the property equivalent to all the surviving legal heirs. This can only be possible if the grandfather died intestate. Also the title documents of the property needs to be perused for any sane advice. Please feel free to contact

If you want to dispossessed someone from the property then in that case you have need to file a suit for eviction and in this regard you have to file a court fees also You need to file a suit for eviction or suit for possession along with the court says you have not disclose the real fact how he came into the position of the property and since how long have been residing in that property and what the title is holding regarding the ownership of the property

Gpa is valid bcoz it created the Intrrest ..it revile gpa we need to read all the clauses to give u better options for the same …after the involvement of money it is protected via 202 CPC however it also depends on other things as well ..b in touch
