Property ownership transfer to mother after father death how to do it

30-Jul-2023 (In Property Law)
My father died without will, leaving behind my mother, married sister(she has given up her claim for my mother on stamp paper attested by notary and judge), me my wife and my minor son. Now we want to transfer ownership in my mother's name. The property is society owned and with patta of society. There is no claim on property other than regular electricity and water bills. How should we proceed with transfer in shortest period of time?

As you said your sister execute a notarised relinquish deed in favour of your mother, however I failed to understand in what manner judge attested it.i am presuming here that relinquish deed is notarised only so get it registered and you, your wife also execute registered relinquish deed in favour of your mother.Minor son can not do this.

Since it is society registered property it is advisable to your mother to file probate petition to the district civil court. It would take may be 3 months. If the property details have been submitted by the society to the jda/nagar nigam or any local authority then you may move an application for correction or entry of your mother name in the papers and get amended patta. Please append the copy of death certificate of your father.
