Transfer of property from deceased father to son

20-May-2023 (In Property Law)
We were a Hindu family of 4 members - Mom, Dad and two brothers. My mother own a flat in Delhi and she passed away in 2014, then my brother and me gave NOC and property get transferred to my father name via relinquishment deed (RD) in 2014. Later in 2015, my brother (unmarried) passed away. Then in 2019 my father got expired. So i am the only person left in family now. So is there any procedure to get the flat in my name by doing RD? (As in 2014 i gave NOC to transfer the flat in my fathers name.) So can it again get it transferred to my name via relinquishment deed (RD).

Sir I have perused your query. You being your father's sole surviving legal heir can apply for the grant of succession certificate in a civil court. Further please feel free to reach out to me in case you wish to discuss the matter in more detail.

Query perused. You have to qpply for legal heir certificate for your brother and your father also before the Tehsildar. On moving the application along with requisite documents like affidavit, death certificate, address proof act Patwari will come and physically verify. Thereafter he will submit a report to the SDM office from where the certificate will be issued. For further consultancy and legal services you may contact us.
