No objection certificate (Hindu Law)

14-Sep-2023 (In Property Law)
Hello, I am the elder son of the family. We are two brothers. Currently, I am residing overseas. My father passed away 10 years ago. He did not have any will. My younger brother is living with my mother and he has been controlling all FD of my father and staying with my mother in the house which my father has constructed. Everything was going good. Now suddenly they are pressuring me to provide with a no objection certificate to sign the transfer of property to my mothers name. I am worried this would lead to then my mother transferring all my fathers property to my younger brother as he is staying with her. Could you tell me how should I proceed with this so I also get my right share and not be cheated. Thanks

The best option is to make this a legal matter. so they will not think of cheating and will stay away from all things. The best thing is to start communicating with your family members and ask for your share. If they don't come on any conclusion, give legal notice in news papers through advocate and make sure no one take any interest in the property.

Then proceed with sub registrar to get your name entered in all properties on the basis of your succession right.
