Godown running in a residential area what action to take to shut it

Sir, I am the resident of Delhi. I have a house in a long narrow street of around 50 ft long and 7 to 8 feet is width of the street. In the street near about 40-50 families are living and a Play school is also running . there is only one way to enter and exit the street. Our Main Problem is that one of the resident of the street has a house on the entrance of the street and he is running a "Godown" on ground floor to supply Gutka, PanMasala, Khaini, Jarda, Supari etc...Loading and unloading operations were being carried out along the road causing inconvenience to residents. most of the time we does not get clear way to go through bike, scooter or bycycle, his clients block,s the street with their bike, Rikshaw and Parked the van on the entrance of the street all the time to load and unload Gutka, Many times we asked him to shut down the godown but he is not agree. we are facing problem while entry or exit. PLEASE ADVICE THE BEST WAY TO SHUT THE GODOWN FOREVER.

You can send a complaint to the MCD. Also, you can give a complaint in the local police station. If the problem still remains unsolved you approach the court for seeking the appropriate relief against the said person.

yes definitely you have your own rights to be availed.so you can definitely go ahead and seek closing of the Godown as running of commercial activities in resedential area is not permitted.it is completely illegal and unauthorised therefore there are different remedies criminal as well as civil which can be seeked over the same.We can go ahead and file complaints at different authorities and we can also file civil suit in civil court for grant of restrain orders against godown nd shop owners besides this we can also approach hon'ble high court.Therefore depends what remedy to be availed by you.

Sir, the way forward would be to file complaints with the concerned authorities (eg. SDMC in south Delhi) stating the various problems faced by the local residents on account of these commercial activities and requesting for a closure of these activities. If no action is taken you may prefer a writ in the concerned High Court seeking appropriate reliefs

In a residential apartment, you can use 220 square feet for commercial purposes. The society will usually allow back office work. Amit Desai of PropInvest Realty says that activities which require the property to be used as cold storage, godowns and laboratories are prohibited.
