Getting certified copies from High Court

26-Nov-2023 (In Property Law)
Hello, I am writing on behalf of my mother by name Y. She needs certified copies of a RFA case in High Court. She is identifed as one of the respondents, but her name is mentioned as X in the case, which is her maiden name, before marriage. She doesnot have any proof of ID with the name X. All she has is with the name Y, which is her current/legal name as per Aadhaar, Voters ID. She also got a notarized affidavit done for the name change (X->Y) recently, but the court didnot consider it. What is the procedure to get the certified copies in this scenario? She does not want to file a vakalath just to get the documents. Regards, BKR

Hi.
1. First and foremost step is to file a name change petition in a proper court and to pay a proper prescribed fees for that.
2. Then the person making the request must publish the notice in a local newspaper stating that he or she has filed a name change petition.
3. Then submit the paper to the Department of Publication.
Thus elaborating more on the procedure :
1.First create an affidavit for the change of name : you need to elaborate the reasons why want to opt for a name change. Then in it you need to mention :
A. Full name of the applicant.
B. Father's name or husbands name, ( in case of married woman)
C. Full residential address
D. A declaration stating that the facts provided in the affidavit are true and correct.
2. Then place an advertisement in newspaper.
3. Then you need to furnish documents required for the name change :
a. An affidavit duly signed by the applicant and it should be attested by Judicial Magistrate/ Notary.
b. Original newspaper in which name change ad is given.
c. The contents of the soft copy ( typed content, not a scanned copy) of the application in the MS word format. In place of the signature the applicant's own name is to be given and the witness details need bit be included.
d. A certificate should be there in which the applicant declared that the content are similar in both soft copy and the hard copy. The applicant should duly sign the certificate.
e. Two passport size photographers, both self- attested by the applicant.
f. A photocopy of a valid ID proof, self-attested by the applicant.
g. A request letter along with the requisite fee as per the Authority.
4. Then finally you need to apply for the change of name in Gazette.

certified copies half documents pertaining to a matter in High Court are issued only an application by ai person who is in some way connected to the matter. therefore if she wants a certified copy of something some advocate has to file a vakalat on behalf of her are somebody who wants to implied himself /herself in the matter. handling of documents issuing of certified copies has become more difficult after coming into practice of the new sop.
