Can adopted children ask for a share in the property of the parents?

15-Aug-2023 (In Property Law)
Hello, I am looking for an expert advise on our property dispute with my uncle. Here I would like to give the brief detail of the case. I and my little brother were adopted by our uncle (big brother of my father) after our parents died, we were only 5 and 2 years old at that time. My father was a govt servant and so my uncle gets my father job with the condition to serve and take care of us. my parents had a Fixed Deposit of Rs. 60,000 and our uncle borrow a loan on that FD (as a parental authority) and bought a 100 SQ Yd (100 Gaj) plot in Narela Delhi in 1995 (approx). Since now we (me and my brother) are adult now and so we just wanted to have either our Rs. 50,000 with FD interest or 50% share of the property. Please review and advise if you can help us to get us what is ours. Please call me for more details and procedure and the initial fees / total fees.

Yes you can claim the share of property as per amount invested by your uncle for purchasing the property. However ever more details are required to advise you for further procedure. It is better if you will arrange a personal meeting for same

There are certain rules and regulations and If the adoption was legal as per law though the same can not be questioned now , the adopted son from the date of adoption becomes a son with all the rights and liabilities of a natural son.
However, you have stated that your adopted father has ancestral property . in such a case adopted father cannot gift , transfer ancestral property to brother son and disinherit you .
You can contact me for further action to file suit in court for your share in property .
