Building 3rd floor on the freehold property with 2nd floor roof rights
23-Apr-2023 (In Property Law)
Sir I purchase a 2nd floor flat in the west Delhi with roof rights & now I would like to built an extra floor i.e 3rd floor that too porta cabin. However I will comply rules. As per the MCD norms the building structure is stable to cater the 3rd floor load & the building height would be below 15 mtrs (after adding of that extra floor). Sir, I would like to know which type of documents/clearances would I require before construction. I came to know thru some reliable sources that MCD will take x amount to clear the construction & approve the building plan. Even the co owners in my building are demanding money to allow NOC.
the documents that you would require are clearances from the MCD that you can build a floor as desired by you. for that you may need to visit the office of MCD and talk to them directly, since the papers required from you would be best told by them.

Sir
As per the Delhi building bye laws 2016, you would only require to take NOCs from concerned departments of the MCD. And NOC from neighbours are usually not required for construction of additional floor provided some generic exceptions with respect to their right to life. For detailed answer we would require to peruse the property documents and dimensions as well as the locality and laws prevailing thereto.
Thanks
