Builder trying to build additional floor after 10 years w/o approval

Dear Sir/Madam, My builder after 10 years is trying to build a new floor in our building without approval. And also he has completed the building for us and we build the common area like car parking, drainage etc our selves. We spent around 7 lakhs. How can we tackle this situation.

Where is this exact location? I just wanted to know whether this building come under RERA. There are so many legal remedies to stop the unauthorized constructions. It would be more stronger when you join with other building owners in the same Building and submit collective complaints against the builder. Pl feel free to contact me if you require more details. With regard to your query we have to deeply study the agreements and land documents approvals etc to ensure that he is deviating , without review all documents it is difficult to advice blindly. pls produce the documents to conclude and advice

The builder has no right whatsoever to put up additional construction. If your apartment has an association of owners, it is advisable for the association to immediately file a suit for injunction against the builder. Even if there is no association, a single owner can file a suit and prevent the builder from putting up the construction.

The builder has no right to do such things immediately without delaying approach the court to get injunction order against the activities of the builder. if your association is registered you can file a case by the flat owners Association.
