Can a tenant occupied the flat without paying rent for the last 40 years and denied to vacant.

kindly initiate an eviction proceeding against the tenant if the document of tenancy is in order and the tenant is covered as a tenant under the WB Premises Tenancy Act 1997 or if it's a thika tenancy then as per the thika tenancy act or if it's under TPA act then by invokiing the necessary provisions from that act.

This is completely illegal. Please serve an eviction notice to your tenant asking him to vacate or else provide the rent including the arrears and then if necessary file an eviction suit with one injunction. Also file necessary caveats in the concerned civil courts.
