Rules and regulations regarding Internship for Graduating students

25-Jul-2023 (In Labour & Service Law)
We were hired at an offer of 9Hours of working 6 days a week for 2 months but now we are forced to sit more than 9 hours daily in case we don't achieve our daily target(Achieving the daily target is difficult and most of the full time employs are even not able to achieve it) We decided to leave the Internship at a duration of 40 days but the HR is not confirming our certificate and stipend of these 40 days we worked. What should we do since we are not able tu work in such an pressured environment for such a long duration.

Hi,
There are no law regulating the internship programmes of the organisation. Because of that, the employer enjoys discretionary powers to rule the terms of the internship. However, if you have taken a firm decision to leave the internship few days before the end date, you can draft a formal letter, to the senior whom you report requesting to issue certificate if not for the whole duration but at least till the day you had worked in the organisation and to release the stipend on pro rata basis.

You should write a formal emai to the HR stating that you all are hereby informing that you do not wish to pursue the internship at the given premise and to prepare the internship certificate and stipend based on the same.
Even if they refuse to acknowledge your formal communication over email or refuse to let you go or to give your internship letter and stipend thereto then you are free to go without any problems.
After coming out of the premise send them a legal notice asking for your stipend and internship letter. If they fails to acknowledge the same or refuse to make any comment then drag them before the competent court of jurisdiction.

You are under a contractual obligation to work for 2 months, please check the contract whether you can leave the employer before 2 months and that whether you can claim your stipend for those days. In case you need to work for 2 months to claim the stipend then its better to work for 20 more days and take your stipend rather than fighting for stipend for 40 days.
