Retired till disciplinary authority decided case pension not resumed

domestic proceedings initiated have come to a close after 5 years by tentatively dropping the charge by the Disciplinary Authority; but the decision has reached finality after retirement of the charged officer and ,therefore, the matter was referred to the President of India for getting concurrence as per the provisions of Pension Rules. Now the retirement benefits are getting locked for the technical formality. What is the course should the charged officer take for earlier remedy and redressal. Please advise.

Normally the retirement benefits (other than the pension) will be given even if the disciplinary proceedings are pending.

You may send the request letter along with the relevant forms through proper channel. Get the acknowledgement. If there is no response, you may file a writ petition.
