02-Nov-2023 (In Labour & Service Law)
Respected sir/Madam, I have passed an exam of Assistant Malaria Inspector in East Delhi Municipal Corporation. I have applied for technical resignation from my previous department. My department issued me technical resignation and relieving order. When I went for joining in EDMC for new job. EDMC told me that we have considered you as a fresh candidate. If I join as fresh candidate according to advt of DSSSB I was over age. Now I want to ask you that can I roll back to my previous department. the date of relieving order 23-10-2017 and I file my representation regarding cancellation of technical resignation order on dated 27-10-2017. Sir I need urgent help

I will need few clarifications from you-
1. Was the advertisement for appointment in the new department meant only for government employee or for fresh recruits as well? Will need clarity on the terms of appointment to determine whether your appointment in the new department could have been treated as a fresh appointment. I believe to the contrary. Usually there is a quota for government employees and service rnedered in the previous department is counted unless mentioned otherwise.
2. Regarding your second query since you applied for cancellation of your resignation after it became effective, it’s debatable whether your rejoining can be accepted. However, if your affective date of being relieved is later than you seeking withdrawal of your request for resignation it may work out. You may please get in touch for further discussion.
