employer denies for gratuity after five years of work

Hi sir, my self Anil Kumar i was working in a travel company (Avon India Pvt Ltd.) from last five and two moths ..company suddenly said want to one accountant in the compnay while my profile is credit controller one more account executive working therer. so i have resigned my job position. now company HR said we provide to you only one month salary not gratuity .sir guide me what should i do.

I have perused your query and would advise you to issue a strongly worded legal notice to the concerned directors of the company seeking gratuity. See gratuity is applicable to an employee once 4 years and 240 days of continuous service is over. Its a statutory payment given given under the Gratuity Act as a loyalty shown towards the company by serving for a period as prescribed.
