Am I eligible for arrears if have resigned already

27-Jan-2023 (In Labour & Service Law)

Sir, I have tendered my resignation but not relieved. Mgmt has declared pay revision with the clause that those who have put their paper are not eligible for arrears. My question is that is it legally valid on the part of organisation to give such effect as it is a arrears of my past job and not any extra benefits.

Dear sir

Receving salary alongwith all benefits is a legal right of all employees. The employer must pay the salary till date of last day of service and must also pay all arrears pertaining to gratuity etc.

No policy of the employer can be valid if it is made with a view to bypass the rights of the employee.
The employee shall have the legal right to pursue and avail appropriate remedies based on the nature of employment and the nomenclature of the employer.
