After offer latter not allowed to join on joining date what action

I am a new joining in FIS, Gurgaon. I have Xerox of my offer letter and submitted all documents. 30 people where hired out of which 3-4 where not allowed to join at the date of joining stating reason that my background check didn't come through. We have been put hold. What action can we take?

Certainly, it is right of your employer to conduct background checks before awarding employment, which may be necessary for many reasons, including integrity of employee.

In the event you have submitted correct information, and still you are not being allowed to join , you must seek reasons for same, and make representation that you have provided right information, and you have right to seek reason for putting your employment on hold.

IN the event they do not provide you any such information, you should file suit for damages, claiming loss of earnings, since you resigned on the basis of offer made by them, and there is loss of earning since your organization put your employment on hold.

You must first check if your contact provides that appointment is subject to background check. If it does not then we you can claim breach of contract and file a suit for specific performance of contract.
