What is the procedure of court marriage

I am a HINDU boy. I am in a relation with MUSLIM girl from last 5 years. We wish to marry each other but none of our family members as well as society would accept us. So we wish to go for a court marriage. None of us have someone who could be a witness due to social melodrama. As well as I don't know where to apply for marriage as well as the procedure. Kindly help us as we both don't want to broke our commitments. Do I need to seek a lawyer for this case for the post marriage issues such as threats??? What could be done for the social security and threats???

Presuming both of you are adults and want to marry without changing your religion then you can get married under the provisions of Special Marriage Act.
You have to give a writen notice in the specified form (form can be procured from vendors) to the Marriage Officer of the district where at least one of you have resided for a period of at least 30 days prior to giving of aforesaid notice. The marriage officer will get it published in the Notice Board of his office as well as ensure that notice is also published in the Register of Marriages of the district where parties are permanently residing. Any person can make objections regarding non compliance of the procedure and competence to marriage like age, etc before the expiry of 30 days from the publication of notice. After expiry of 30 days of the notice, Sub Registrar/ Marriage Officer will register the marriage after the parties sign the deceleration form in presence of three witnesses. (Your friends,etc can act as witness). You will be provided a certificate by the registrar. Requirement of lawyer is not mandatory but hiring a lawyer will smoothen the process. Regarding post marriage threats, you can get protection from the local police or approach the courts in case police refuses to help you.

The marriage will be solemnised before Registrar (marriages), Special Marriage Act in the District where you two are situated. Documents required include valid address, identification (photo) ID proof for both of you, some passport size photographs, 4 witnesses and also the valid address, ID proof of the witnesses. Also, you two will have to perform your marriage at a temple, preferably and get valid certificate of marriage issued by Aarya Samaj, which shall be presented before the Registrar. As far as the question of your security is concerned, the relevant Police Station will have to be informed in writing who will take care of the situation. In any case, you go to the Court seeking police protection by filing a writ of mandamus. I hope this reply helps you.

Sir, your marriage shall be registered by the registrar under Special Marriage Act. But sir the basic requirements are at least two witnesses to the marriage, identity proof of the parties and documents showing the majority of the parties. I think your friends may be witnesses to this marriage. As far as post marriage issues are concerned, you need help of police in case of threats etc. not of a lawyer as a lawyer may provide you the legal consultation not the security.

Procedure when both the parties are Hindu:

1. The parties have to file a notice of intended marriage in the specified form to the marriage registrar of the district in which at least one of the parties to the marriage has resided for a period of not less than 30 days immediately preceding the date on which such notice is given.

2. The notice is then published/put up inviting objections if any.

3. After the expiration of 30 days from the date on which notice of intended marriage has been published, the marriage may be solemnised at the specified office.

4. Both parties along with three witnesses are required to be present on the date of registration/Solemnisation.

Documents required:

1. application form in the prescribed format with the prescribed fee.
2. passport size photographs of marrying persons
3. residential proof of marrying persons
4. date of birth of marrying persons
5. residential proof and PAN card of three witnesses
6. death certificate of divorce decree whichever is applicable, in case one of the parties had any marriages in the past.

(There is a different procedure when parties belong to different religions)

For solemnisation of court marriage, first of all, you should move to the city where you want to solemnisation the marriage 30 days before. After that you have to give a 30-days notice in newspaper for anyone to raise objection if there are any. After that the marriage is solemnised in the presence of the marriage officer of the district.

According to Prohibition of Child Marriage Act a girl can legally marry only after completing the age of 18 years of age and that of boy is 21 years. Any marriage that is solemnized without compliance with the same will be illegal. An agreement to marry executed by a girls below 18 years of age will not pass the judicial scrutiny. If their parents are forcing her to marry before she is 18 years then you can bring it to the knowledge of the local administration like District Magistrate, Social Welfare Officer, Police, etc. It is punishable offence.
