PARTITION OF THE FAMILY PROPERTY

We have a land in jaipur. The title deed of the full property in one of me uncle's name. This property was shown in the wealth tax of my Grand Father's HUF from the time property was bought till the time the returns were filed.
We want to divide the property in 3 parts. One of the party wants to start construction without the finalization of the division. What is the Legal status of the property, can I apply for a status quo order from the court till the division is finalized, Please Advise
