Mother and Daughter family issues

06-Jun-2023 (In Family Law)
We are twin daughters to my mother, my father passed away few years ago, my younger sister stays close by to my mom i stay in kharagpur with my husband. My father had made a will (more like a gift deed) in which he granted his current residence to my younger sister completely without mentioning anywhere in the will that he has 2 daughters or even the fact im not receiving anything. Now my mother is planning to sell the other ancestral property in which they are again planning to not give me anything. she doesnt acknowledge me either as her child, she keeps mentally harassing me by spreading rumours about me and bad mouthing my husband and daughter, i have stopped taking her calls as its too regressive. Still she goes ahead and starts calling up other relatives asking for money every month. I want to know what legal action i can take to stop all this and also is it necessary for me to pay monthly for her when she doesn't acknowledge our relationship in decent manner

First of all if your father made a will did they take probate of that will till date?Secondly if your mother does not wants to give you share of that property then immediately file a partition suit along with injunction to stop your mother from selling.

In this regard you can file an injunction before the civil court for them to come to court and decide who will get what and the judge will equally give all your shares upon an order, and no one can sell and demolish the property till disposal of such case.
