Is a US Diovrce Decree valid in India?
18-Sep-2023 (In Family Law)
My ex husband and I got married in India in 2010 & moved to the US immediately after. We filed for a divorced in the US (California) in Dec 2013 starting "irreconcilable differences" as a reason for the divorce. There were no kids involved and a very smooth divorce. I current have the US decree with me as evidence of my divorce.
My question is - is this decree valid in India? If not, what's the process to get it validated in India?
Religion: Hindi/ Sikh
Important thing is first whether marriage got solemnized as per Hindu Law. If dear marriage took place as per Anand Rituals. You have to obtain decree as per Hindu Marriage Act. If you wants to marry in India then first you have to apply for decree before Family Court or before Civil Court Senior division if Family Court is not in your district.
Dear queriest, as per your query you have mentioned about the fact that you and husband got married in India and got divorced in US, and the same is not valid as per Indian Law. If you want to get valid divorce, you have to file for divorce in India and get it legally status as per Indian Law for more please call me for the same.
