How to legally separate from abusive family

01-Aug-2023 (In Family Law)
I am a 18-year-old girl My family is sexually and physically abusive. I tried to report police but they gave no concern towards me and accused me of misbehaving at home. I have a nice job and I can definitely take care of myself. So I want to legally leave home because I know I have a right to do just that. Please tell what should be my first step?

Dear Client,

As you are being subjected to mental and physical abuse and in extension of your query, you already had approached the conserned police station but no heed was paid to your request.
In the circumstances stated by you hereinabove you need to approach immediately to the concerned court and file an Application under 156 (3) Cr.P.C. thereby compelling the concerned police station to lodge an FIR and to further investigate into the matter.
Along with the procedure mentioned above you should also approach the concerned Family Court for the decree of divorce on the ground of mental and physical abuse.
In case you need further advice into the matter, feel free to contact.
Regards,
Tushar Bahadur,
(Advocate),
High Court Lucknow.
