To change your name in your birth certificate in Delhi, you will need to follow these steps:

  1. Obtain the required documents: You will need to obtain the following documents:
    - Original birth certificate
    - Affidavit for name change
    - Two newspaper publications announcing the name change
    - Gazette notification (optional)
    - Identity proofs like Aadhaar card, PAN card, etc.

  2. Draft an affidavit: You need to prepare an affidavit stating the reason for the name change and the new name you wish to adopt. The affidavit must be attested by a notary.

  3. Publish newspaper advertisements: You will need to publish an advertisement announcing your name change in two newspapers - one in the local language and the other in English. The advertisement should be published in a national newspaper and a local newspaper with wide circulation in the area of your residence.

  4. Apply for a Gazette notification: After publishing the advertisement, you can apply for a Gazette notification in the prescribed format. The application must be submitted to the Department of Publication, Civil Lines, Delhi. The application should include the original affidavit, original birth certificate, and newspaper publications.

  5. Submit the application to the Registrar of Births and Deaths: Once you have received the Gazette notification, you need to submit an application to the Registrar of Births and Deaths. The application must be accompanied by the original birth certificate, the affidavit, the newspaper publication, and the Gazette notification. You will also need to provide identity proof and proof of residence.

  6. Pay the applicable fees: You will need to pay the applicable fees to the Registrar of Births and Deaths for the name change.

  7. Wait for the name change to be reflected in the birth certificate: After submitting the application, you will need to wait for the name change to be reflected in the birth certificate. This may take some time, depending on the processing time of the Registrar of Births and Deaths.

An application needs to be filed to the Issuing Authority i.e. Registrar of Births and Deaths under the concerned municipal corporation (SDMC/EDMC/NDMC) containing a brief statement and all the documents in favour of changing the date of birth. Hospital discharge certrificate of the birth is also needed if available.

If registrar rejects the application then you can approach the High Court under writ jurisdiction to issue order to the registrar to effect the change.

Changing the date of birth on a birth certificate is a legal process that requires careful documentation and adherence to specific procedures. Here's a guide on how to change the date of birth in a birth certificate:
1. Determine Eligibility: Before proceeding, ensure that you have valid reasons for changing the date of birth, such as errors or discrepancies in the original birth record.
2. Gather Supporting Documents:
  • Obtain your original birth certificate, which you intend to correct.
  • Collect documents that provide evidence of your correct date of birth, such as school records, medical records, or affidavits from family members.
3. Contact the Local Registrar: Visit the office of the local registrar where your birth was originally registered. This is typically the municipal or district office responsible for birth records.
4. Request an Application Form: Request an application form for correcting the date of birth in a birth certificate. Fill out the form accurately and completely.
5. Attach Supporting Documents: Along with the application form, submit all supporting documents that confirm the correct date of birth.
6. Affidavit: In some cases, you may be required to submit an affidavit explaining the reason for the correction. This affidavit should be signed and notarized.
7. Verification: The registrar's office will verify the submitted documents and may conduct an inquiry if necessary to confirm the accuracy of the requested correction.
8. Fee Payment: Pay the prescribed fee for the correction process. The fee amount may vary depending on the jurisdiction.
9. Correction Process: Once the application and supporting documents are verified, the registrar will initiate the correction process. They will issue an amended birth certificate with the corrected date of birth.
10. Retain the Corrected Certificate: After the correction is made, ensure that you retain the corrected birth certificate for all future official purposes.
11. Update Other Documents: After obtaining the corrected birth certificate, update your date of birth in all other official documents, such as identity cards, passports, and educational certificates.
12. Legal Assistance: If you encounter difficulties during the correction process, consider seeking legal assistance to ensure a smooth resolution.

You must provide convincing evidence to the court that the information listed on your current birth certificate is inaccurate in order to legally change your date of birth. Judges tend to be reluctant to issue orders to change birth dates, especially if the date listed is incorrect by less than a year.
