My wife want mutual compromise

Myself Ankit frm noida. mera case (Domestic violence)2016 se delhi court mai chal rha hai... meri wife na to sath rhe rhi hai or na he divorce de rhi hai .. lekin abhi wo kuch dino phele mujse milne aayi or boli ki agar mai uski kuch baate court mai accept kr lu to wo apna case wapis le legi apsi samjote se lekin divorce fir bhi nhi degi bas case wapis legi.. lekin muje ush par trust nhi lekin wo bolti hai ki wo ye stamp paper or affidavit par like kr degi ki mai uski kuch baat court mai accept kr lu to wo case wapis le legi... ab muje ap logo ki advice chaiye ki muje kya karna chaiye ...... hi, you should ask for her terms and then proceed for any kind of settlement. You can also enter in to a Memorandum of Understanding if in case, the terms and conditions are reasonable for you. If she is not ready for MOU, ask the court to direct you both for mediation since she wants to settle the matter.

First of all you should send a legal notice to your wife for restitution of conjugal right then file a petition against your wife for restitution of conjugal right under section 9 of hindu marriage act before the family court Noida. if your wife willing to widrawal of domestic violence case then there is no harm to accept few conditions of her if these conditions are acceptable to you. if your wife after judgment and decree pass by the family court still not return back to her matrimonial home and not perform her duties as wife then in that case you can file a petition against your wife for divorce on grounds of desertion and cruelty under section 13 of Hindu Marriage Act. Dont state anything on affidavit. If she really wants to settle and compromise, a memorandum of settlement can be drafted narrating everything and both parties (i.e. you and your wife) should sign. Thereafter on the basis of that memorandum of settlement, cases can be withdrawn without any problem.

hello Ankit, firstly before accepting the allegation make sure if you have actually committed them. warna Aisa Ho jaayega ki ek Baar accept karne ke Baad you won't be able to prove your innocence. 2ndly if she doesn't want to take a divorce then ask her to stay with you?.
