Q: Phone Spying by my estranged husband ,Is it illegal to spy on your spouse in india ?

I am staying separately from my husband since last two years. We have pending litigations of divorce, child custody, domestic violence against each other. However, I suspect he has put my phone on surveillance, is spying on someone illegal ? and can he use those recordings in court against me?

phone tapping is an illegal and criminal offence in India. it can be done only under the authority and permission of the central or state govt. it is against the article 21 of the constitution which talks about the personal liberty and right to privacy is a part of personal liberty. if you are suspecting your husband being spying your phone. you can either lodge an FIR at your nearest police station or can file a case in the court under Section 26 (b) of the Indian Telegraphic Act.

Q: FIR is filed, What happens if accused is absconding ?

What if an accused person against whom an FIR is filed has been evading/ absconding ever since the day of the commission of a cognizable offense ? if accused is absconding, does a court issue summons and then warrant ? kindly let me know the procedure

Q: Recovery issue of a loan given to friend

A friend to who owes me around 33 lakh (20 lakh principal + 13 lakh interest) given in Loans (documented in loan agreements) of Rs 5 lakh(through cheques) in Feb 2021, Rs 10 lakh(through cheques) in Aug 2022, 5 lakh(through online modes but no agreement) is giving execuses of financial crunch. I have proofs of loan agreement of 15 lakh, chque/bank transfers, voice call recordings, whatsapp video call recording. I am pushing him to create a new agreement mentioning the latest amount that he owes
