Discharge Of 498A case In Court

06-Aug-2026 (In Domestic Violence Law)
We have been accessed by wife in 498A case and 2 hearings are done without the charge put up by the court for proceeding further. Lawyer prior o 2nd hearing informed that we can file for discharge of case if in 2nd hearing also case is not taken by court, so accordingly we said ok but after few days lawyer informed that due to sexual comment by your father mentioned in Chargesheet against your wife we cannot file for discharge and have to proceed as per regular hearing process. Is it true or still we can file for discharge as remarks are not serious but written by her in such a way. What are the remedies please suggest

You can still explore the option of filing a discharge application, as its maintainability depends on whether the material in the chargesheet discloses sufficient grounds to proceed, not merely because an allegation of a sexual comment has been made. The merits of the allegations, evidence, and stage of the case need to be examined carefully. I can review your chargesheet and court proceedings and advise you on the best legal remedy, including whether a discharge application is likely to succeed.
