Advice for legal action against my husband

My husband has been in an extramarital affair for5 years with a married woman . We werecompleted to years of marriage and having a one year old girl child. They both were hiding their relationship and planning for future marriage. My husband abuse me physically and mentally on asking about his relationship with her. I have been in depression for one and a half year.I am having 6 months call recording of their chatting and some photos. What can I do to save my marriage or what legal action I can take against my husband and the women. She is12 years of marriage and having 2 children. Her husband don't know about the relationship. My husband says women that he married to mr under family pressure.

as I have read ur query I can understand the tension and pressure on you.you have completed 5 years of marriage with your husband and ur also having call records as well as ur also having photograph of both of them in this condition you can take legal action against your husband and as well as tht lady also with whom your husband is in relationship. in this matter you have to file a criminal case against both the persons and you can also file DV also in the court .

Query perused. I would advise you to engage a lawyer for filing a petition under section 12 of the domestic violence act seeking maintenance, compensation and separate residence order. Would advise you to file a section 125 crpc for maintenance also. Further would advise you to file a complaint before the women cell for cruelty. You may have one face to face confrontation with your husband. If things don’t improve then you have to take some steps.
A Police complaint in CAW cell (Crime Against Women) of domestic violence and the extramarital affair (mental torture & harassment) must be filed.

you can file 498a FIR against your husband, as well as domestic Violence case, but I would suggest that do not try for reconciliation because he already in a relationship and he can do this again and again. To save this marriage, mediation will help you totally. so the other option I would suggest is mediation.
