My husband is having relationship with another woman and has illegitimate son with her. I am living separately with 9yr old son since last 1 yr. My husband was not living with me since last 4-5 yr. I was staying with my in-laws. Now I want to know what options I have . How to and what are cases I can file against him.

You can file for divorce on the ground of cruelty. Further maintenance for yourself as well as for your son can be claimed. Also you can sue your husband for bigamy if he has married the other lady. However better advice can be given once you share the real intent of yours before suing your husband in a court of law. Please feel free to contact Thanks

After perusing the contents of your query, we would like to advise you that you have certain options available under the law like filing a domestic violence complaint under section 12 and seek compensation. Further you can file petition under section 125 CrPc and seek monthly maintenance. Lastly you can directly file a divorce petition on the ground of cruelty

You can file for divorce on the grounds of cruelty and even bigamy, if your husband is already married to the other women. You can also file a case for maintenance for yourself as well as for your son. In order to take more precise legal advice, you need to share more elaborated details with me for your case, only then I’ll be able to guide you through. You can always file a DV case against your husband and demand separate residence+alimony for yourself and for your son. Since your is in relationship with another women he will be prosecuted under bigamy also. You can also file for divorce under the cruelty ground.
