Regarding mental and physical torture case.

It's regarding torture ( mentally and physically) case of my own little sister by his husband. Need to know the procedure. My parents are going tomorrow to bring my sister and her daughter back to our home. They are about to file a case of torture to the nearby police station tomorrow. Is that sufficient or give advice?

As per ur case u can file FIR in nearby police station against your sister husband and his family. It is not condition that you have to file in other places. It is possible for you to case of physical and mental harassment case.

Because this is family matter so that I advise to you first of all don't file criminal case in police you may also file domestic violence Act Instead of Police case in this case first of all police do not take action so relation maybe chance sustain again. There after you have a many chance to criminal case and family case against sister husband

It would be gud to inform the nearby police station first , and aftr that u can file a criminal case of sec-498A against ur sister's husband in the court , and can also file a maintenance case to get maintenance for ur sister and her children from him...for further query u can contact me...

Respected questioner,
You have to two options one to file FIR before police station under cruelty and dowry & prohibition act and other options to file complaint case before Court under same heading. Feel free to call and give your feedback.

Dear Sir

FIR can surely be lodged alleging torture against those responsible and if police refuses to register FIR then the remedy is available to report such non-registration by post to the jurisdictional SP within 24 hours. Even if no action is taken, remedy is available for filing a criminal complaint before the jurisdictional Judicial Magistrate.
