Lodging an FIR against husband & in laws for dowry & stridhan in CAW

I had put my complaint against my husband & in laws in CAW cell this year in june... since then we have been given 7-10 dates for mediation but my in laws have refused to return / posses my jewellery & belongings... now i uv closed my mediation sessions but my husband has filled divorce case against me... will now FIR in 498a be lodged against him??? Can they get bail easily???

I have perused the contents of your query. As you have apprised that you have lodged a complaint before the CAW cell and numerous dates have already been concluded the matter will be referred to mediation centre in the court and thereafter if no settlement is arrived at the complaint will be recommended for FIR. Filing a divorce case is not a bar for registering an FIR.

Hi,

Yes FIR will be registered against your husband and in laws named by you in the complaint filled by you .

Get bail depends upon the allegations against the accused persons , I need to see the complaint to brief you more on 498 A.

The IO will register an FIR is sufficient allegations are there in your complaint. You should peruse with the IO.
The in-laws can surely file anticipatory bail. When it is filed the IO should inform you and you will be allowed to join the hearing. In case serious allegations are there in the complaint, they should not be granted bail. You should join the proceedings and oppose grant of bail.
Divorce are separate proceedings which have no bearing on the FIR or Domestic Violence proceedings.

bail very easy ground is proper ground of the bail don't worry we are done the bell easily any Court contact me on my contact number we are also having this type kisses and we also get bail normally

yes absolutely your rights you can file against husband 498 a and skits mentionable on laws 498 a proper ground ground of the 498 a you file when both are giving the all materials and everything's dignity

yes. you can file a 498a against your husband. whether or not your husband can get bail is dependent upon the facts and circumstances of the case, but yes, since the laws are bent towards protection of women, it is a little difficult for your in laws to get bail in such matters.

Yes the FIR will be lodged against all the accused person. Nowadays bail is not that issue in dowry harassment it is only issue when accused person failed to join investigation. Apart from CAW cell you can file other cases against ypur husband and his fanily members as well as after registration of FIR you can insist the IO to file application for search and seizure of your article along with bank lockers

FIR is filed on the basis of information disclosed by the complainant should be prima facie be genuine and shall disclose a cognizable offence.

there's already a delay in lodging of the fir against your husband and your in laws for the cruelty done to you.
you should also write an application to the concerened ACP for the failure in mediation proceedings in the CAW cell.
As regard to the bail. you need to put in some serious and actual allegations against them so that they can be kept behind the bars for long.
rest can be discussed over a call or a legal meeting.

yes you can file fir under 498A and ask for maintenance as well and then simaltaniously other matters will run parallel to this case and if you are contesting divorce then continue to do so . utimately things will get settled.

Yes 498a can be lodged against your husband as well as you in laws. Alongside divorce, you have other legal remedies available before the court.
Getting bail is not that simple. Though it is a subject of a prima facie case with evidence.

Ma'am you need to get FIR registered against your husband (in case it is not registered yet)
under section 498A and various other sections.
By writing a complaint to concerned SHO.

Regarding Bail I can only say that if they have reasonable ground they will get Bail.

Also we advice our clients to Lodge FIR not only in name of husband but also in name of In-Laws so that you can pressurize them to give your jewelry and other articles back and get a decent amount of maintenance.
