I want to divorce my wife due to seperation from my mother

I had arranged marraige in 2007 but my wife won't stay with my family till date . She wanted both stay another place . She and her family wants to seperate from my mother . That why i have no child because we are not staying together and our physical relation ends 10years. So i want peaceful life . She also psychiatric patients last 5years and her family also also

If your wife is agree with your opinion to divorce each other then you have to file a matrimonial suit under section 13b of the Hindu Marriage Act 1955 before the concerned Sessions Court. And if not you have to file a petition under sec. 13(1) of the Hindu Marriage Act 1955 for the ex Parte divorce.

If your wife is ill court will not allow you to divorce her. If you have anything written over email and whatsapp where your wife states she will not stay with your aged parents then upon showing such proof you can obtain divorce at the earliest

you can obtain divorce by filing a petition for divorce in the district judge's court of your jurisdiction. according to marriage laws you can file a divorce if you didnot have a sexual relationship with your spouse for a prolonged period of time.

You can file a divorce case on the ground of cruelty. The Supreme Court in Narendra vs. K.Meena, held that persistent effort of the wife to separate the Husband from his parents constitutes the act of cruelty, which is a sufficient ground to grant divorce.

If your marriage was solemnised under Hindu rules then you may file divorce suit under section 13 Hindu marriage Act .your wife will appear in the case and if she contests then that will continue .but if she doesn't contest then you may get exparte decree
