Husband has filed divorce under section 13 (ib) under HMA

I want to reply to legal notice sent by husband and also want to file maintenance for my self and my child.

if husband has sent you legal notice. The first step is to give an reply to the legal notice through your advocate. You can avail other remedies like you can file maintenance case against your husband in court.

you can reply to legal notice by raising your appropriate defense. However, if you urgently want maintenance for child and yourself, it is suggested that you file a maintenance case u/s. 125 crpc. However, if you can wait for maintenance, then let the husband file for divorce case, in that case you can ask for interim maintenance amount. in case you require any further legal assistance you may contact me.

yes you can file for maintenance and also under the provisions and protection order od Domestic Violence. You can oppose his divorce petition by filing written statement and can oppose his divorce petition.
