Questions Answered by Advocate Vikrant C Deshpande
Q: Girl's Parents opposing to marriage
Hi, I am 32 years male and my girlfriend Is 26 years. Her parents, especially her dad is very strict regarding getting her married and he only wants to get married to the guy he chooses. However, we are determined to get married to each other by April. For safeguarding us regarding violence or any other action taken by her father, are there any legal procedures or complaint filing that needs to be done before we do a court marriage? I don't want her father to create any issues regarding us
Advocate Vikrant C Deshpande answered
File a police complaint: If your girlfriend's father engages in any form of violence, criminal intimidation, or other illegal activity against you or your wife, file a police complaint immediately. This can lead to legal consequences for him.
Q: Received wrong colour vehicle from the dealer while I booked another
I booked white coloured car but on delivery they brought blue car. While we clearly mentioned we wanted White car only, there are proofs of whatsapp group chat where the colour mentioned is white. The dealer has promised for white colour. The RTO has been cleared, EMI is in my name and insurance too. But I have not signed any agreement/documents/deed for the sale. What can be done? Can I file legal case?
Advocate Vikrant C Deshpande answered
You have to send them a legal notice demanding white colour car and RTO registration in your name, if they don't comply with your request, then you have to file case in consumer forum for justice.you have to approach a lawyer.
Q: Need Advice on Annulment/Mutual Divorce
Hi, We got married last year in Jan 23 and now we both want an annulment/mutual divorce. We wanted to know is there any way as per Indian Law that we can file for the annulment? Please advise
Advocate Vikrant C Deshpande answered
Unfortunately, in your situation, filing for an annulment under Indian law might not be feasible. Annulment in India typically applies when the marriage itself was never legally valid due to factors like:Bigamy: One party was already married to someone else at the time of your marriage.Underage marriage: Both parties were underage at the time of the marriage and didn't obtain the necessary court or parental consent.Mental incompetence: One party wasn't of sound mind at the time of the marriage.Concealment of crucial information: One party concealed a crucial fact like pre-existing pregnancy or impotence, leading to the marriage being based on fraud.Given that you both entered into the marriage willingly and legally last year, it wouldn't fall under any of these categories. However, you do have the option to file for a mutual divorce under the Hindu Marriage Act, 1955 or the Special Marriage Act, 1954 (depending on your marriage type). This process is generally faster and smoother compared to contested divorces as both parties agree to dissolve the marriage.
Q: I want to know wife's right after police complaint against my husband
My husband having addiction of alcohol, gutkha, tobacco, pan. And he having anger issues. Always gv threats me. One night he lost his patience n he started abusing me mentally n physically. So I informed to my family they dialed 100 no. N with there help my family rescued me. After that I lodged police complaint by ipc 323,504,506 against them. You must follow the police complaint you have made with the local police station and also have family meeting with your husband's family and relatives and get all written assurance from him. If you do not wish to continue the matrimonial relationship then you can file for judicial separation or divorce case against him and also you have the right to file domestic violence case.
