how can i be seperated with my husband due to verbal and mental abuse so that i am not tortured anymore? i want divorce as soon as possible and i want alimony too

Dear client,


You can file domestic violence act case against ur husband and in domestic violence act case u can claim maintenance and residential from ur husband. Dear client u can also file CAW cell complaint against ur husband for registration of FIR under section 498A and 406 IPC. Dear client you can also file divorce case against your husband. Dear Client,
if you are firmly determined to be separate from your husband who is abusive and mentally torturing you , then you can go for a legal notice to him which will be basis of divorce fling , but if you have been crossed 1year for your marriage period.
Divorce can be given only after 1y of marriage.

you can file divorce petition by two ways 1 by filing Mutual petition if both the parties are agreed and other way is to file contested divorce and for the alimony you can file maintenance so that he can maintain you either by giving you money monthly or one time

you have various remedies available to you, civil as well as criminal. whether you'll get alimony or not and if you get it then how much, will depend upon various factors like your husband's income and yours, the qualifications, etc.

if you want to get separated from your husband due to mental and physical torture what you need to do is to file a divorce case either mutually or contested and in respect of alimony you need to file a maintenance case as well before the court to get remedy from the court
