false divorce case filed by sisters in laws

hi, A divorce case was filed by my sisters in laws, my husband name has been falsely implicated with my sis as having extra maritial affair. the supporting evidencce is of our south trip in which i clicked my sis and husband . what can be don in this case. can i file case of defemation and false allegaton.

first of all you should collect whatever documents she had filed in case and on basis of that pleadings have point out contradictory real facts and can file defamation only when court reject her petition.

Well, you can certainly file a Defamation Case, if the filing of Divorce Case on the basis of Adultery has publicly mocked the relationship between you and your Husband on the allegations made by the Inlaws of your Sister, that, your Sister is having affair with your Husband, which is absolutely false, as per your own statement, as you are the affected party, you can certainly file a Defamation Case

yes , u can file a defamation suit and also claim for damages in a civil court for harm caused to reputation, mental distress, etc. if there is an ongoing divorce petition in the court ur husband can file an application under Order VI Rule 16 CPC or Section 151 CPC to strike out the false pleadings. also Submit your affidavit as a witness stating that the photo was taken innocently and that you were present.

DEFAMATION case cannot be filed in this case, as any misstatements in court proceedings does not amount to Defamation under 500 of Indian Penal Code. As I understand, your husband has not been made a party in the case. Therefore, there is nothing that your husband can do, as he is only a witness in the case. At this point of time, you can ask your sis-in-law to mention about the south-trip point in her written statement for justification. If your husband is summoned in court as witness for testifying in court, then he can inform the truth to the judge. But if any other case is filed against your husband specifically, then your husband can file an application to get discharged from such case.
