yes , u can file a defamation suit and also claim for damages in a civil court for harm caused to reputation, mental distress, etc.if there is an ongoing divorce petition in the court ur husband can file an application under Order VI Rule 16 CPC or Section 151 CPC to strike out the false pleadings.also Submit your affidavit as a witness stating that the photo was taken innocently and that you were present.
