Clarification regarding procedure of divorce

My sister is 27 years old and her marriage lyf is 6 years old, she has two child, her husband and in laws torture her physically and mentally, we want to file a case against them and want divorce....how much tym goes in divorce, bcoz my sister wants monthly security from him as money.....plz advise me

You fule a complaint under sec 498 gor domestic violence so that anuthing further cannot take place for your sister..... Apart from that you can file for divorce and also can claim for maintenance for your sister and her children under section 125 crpc. Her woukd have to bear the expense for your sister, her children as well as the legal expenses.

Your sister can for criminal case against her husband and family members, who are torturing her and get them punished. Simultaneously she can also file a maintenance petition claiming maintenance for herself and her minor children. Court will certainly allow the maintenance petition.

Your sister can file divorce in her district family court where she is residing. Final decision of divorce case will certainly take time but during pendency of the case, she can pray for interim maintenance for herself and her children.

Have you filed fir for the physically and mentally torturing before local jurisdiction police station? If not then go for that first. Then file a maintenance case before family court it will be a better way to reach to justice.

First of you should file a maintenance petition for 125 nf crpc in the court of principal judge family court as well as you should also file a divorce petition in the family court u.s13 of himdu marriage act 1955.
