Section 379 of the Indian Penal Code is a cognizable and non bailable offence.In such type of cases police have no power to give bail to the person who is accused of theft under section 379 of the Indian Penal Code. You may apply for anticipatory bail .

Q: How to get divorce from a mentally ill spouse ?

My brother want to file a divorce against his wife, she is mentally disturb, she often becomes violent and start quarreling with them. But we don't have any proof. There fore, can we keep detective for proof. Your brother can file matrimonial (divorce) petition before the principal judge, family court narrating all those facts and make a prayer for grant of decree of divorce. The Court after considering the case of the parties may grant decree of divorce.

Q: Partition suit in which one of the partition paper is there but plain

We have partition dispute in which four partners are there and there a simple paper partition occured but the one of the clauses my father was not agreed, but have to sign the paper on pressure. Now je wants a justification by court and equal partition. Due to some problem he has also sold some of the property but willing to decrease the amount in upcoming partition.Other partners are not willing to do so is there any law by which the partition can happen by court.

Yes,you can still file partition suit for partition of your ancestral land in the civil court of the district where property is situated . You may raise your grivance regarding internal arrangements with regard to partition of property and may make prayer for carving out of your proper share in the property.

Q: Bail Rejection By High Court Of Patna

Sir we applied for anticipatory bail in 307 in patna high court but that was rejected saying that apply for regular bail then the person surrender in front of court and he is in jail for last three months.we applied for regular bail in high court and that was also rejected.what is the way ahead in this case.why regular bail is rejected when the person himself surrender before court?

you may move before the Hon'ble Supreme Court against rejection order of the Patna High Court by way of filing S L A . Supreme Court may grant bail after appreciating your contention and the material available on the record.

If you both are adults then you may submit properly filled up farm along with affidavits and other relevant required documents to the sub registrar of marriage of your district. After submission of properly filled up farm and after lapse of 30 days your marriage will be registered.
