Q: Want to know about the process of divorce.
I am not living with my husband since last six months and want to file a divorce. But i am not sure of the process. Moreover we r in different cities. My 10 yr son is living with him. As far as custody is concerned I am ok with my husband keeping the custody but want full freedom to meet my son. I would be really grateful if someone shares the detailed process as i am totally unaware of what to do.

Yes you may proceed with one sided divorce process, on the ground of desertion as well as cruelty.In the divorce proceedings itself we have to ask for meeting right as an interim relief. For the ground of cruelty you should have a strong evidences supported by oral evidences.
Q: Can the police remove sections from an FIR when preparing the charge sheet?
We filed a case under sections 323/341/379/34 in 2016, but after the charge sheet, the police removed section 379 due to opposition. We were not present at the time of the charge sheet. We're unsure whom to approach regarding this matter. Currently, hearings have begun, and the opposing party has attended around 10 hearings.

you can file protest petition in the concerning court now and further at the time of framing of charge magistrate will ad up this section. and by this way you can again ad them in your case. if still there is any other query then you can contact.

okay yah batayiye ki usne kab divorce file kiya hai or usme aap appear ho gye hain ya nahi, or us case me bhi aap maintanance ke liye daale hain ki nahi, section 125 file karne k baad turant section 24 of hindu marriage act ka bhi daalna hoga

aap ki baaton ko samajh gye, pahle to aap ko yahi suggest karenge ki agar shadi bach sakti hai to bacha ligiye warna agar aap ne man bana hi liya hai divorce ka to hum log file kar sakte hain manshik pratarna k ground pe.

My wife lived with me less than a month and left me and never came back. She live alone in Burdwan at place other than her paternal home, I.e. Hooghly. I visited her many times to take back. Now, she doesn't want to come back and we are only in touch with phone. We both are divorcee and I have a 11 years old son, whose custody is with his mother. My wife objects me to meet my son. She had problem to meet me with my old aged ailing parents, dependant on me. I live at govt quarter in Nalanda, Bihar as I am a Central govt servant. My wife threatens me to implicate me and parent in false case and 498A. I want divorce on mental cruelty ground..can I file for divorce from the place,where we lastly resided as married couple, i.e. town where I am posted.
