Q: Grandfather died without any will uncle not giving proper share

Sir, Property is purchased by my big grand father and my father has done division with my 2more uncle but the land division is incorrect .few property given by my big grand mother as a Daan equally to my father and my uncle many years back now the recent division taken back my previous writes on the no of plot and same time I am suffering that I need my own share from my father and uncle but he is not giving me.Therefore how I get my own share form my father and my uncle as they are taken approval of my father for his own division.sir please suggest the correct step that I can eqquel share.thanks!!!

You will have to file partition suit, stating therein all the relevant fact, regarding earlier partition and and any other facts , if any. You will have to prove your claim, before the court, with support of relevant documents.

Yes you can sell your own share. You are one of the legal heir of you mother and entitled to get one share in her property. You are free to sell your own share. There is no difficulty in it. However it is advisable to get it done by the consent of all.



Q: Can own share of the house be demolished of combined property

I am a muslim. I have a house in the name of myself & my brother. It’s a 2 storeyed building. Now we have mutually decided to divide it & one part of the building has been given to me & the other half to my brother. Now i want to demolish my share of building & construct a new one since its very old. But my brother is objecting to it & has stopped me from demolishing. He says since it has common foundation, I cannot demolish & build my share of the building. He is doing so to harass me. Kindly advise if he can stop me from demolishing my share of the building & if yes why?

No . Legally your brother can not stop you to reconstruct your house. Only you will have to take care that you are not damaging his portion. You can take the help of engineers so that your portion can be safely demolished



Q: How to prove bigamy by wife in the court

I got married few years back (child marriage) now I'm 24 year old . Actually I was never happy with the marriage but family forced to stay with her . Back in 2017 feb she filed a case under ipc 498a , 341 and 323 . In the FIR almost every information was false given . So I got bail from the court . Now we find out that she got married again with someone and she have a baby girl but case is still pending . So finally what Should I do , can I file bigamy case against her but I don't have any documents of her marriage ceremony but we have some witness ,. Is it sufficient to file bigamy?
