Case of divorce from greedy husband and want my child custody

Hello sir, I want to take divorce from my husband since he is not taking my responsibilities seriously. If I complain of it, he will start fighting. I am fed up now and thinking of taking divorce from him. But my problems is that this is my second marriage and I do not want to lose my child custody. One more thing, he always tries to prove that i am mentally sick. He had taken a huge amount from my father also. Before marriage, i had no idea that i am marrying a guy who is after money. But later, i realized that. But my father never took me seriously and he secretly gave money to him. What should do now? I want my money back also.

Hi mam good eveing Firsy or all yes u Can Ask for divorce plus maintenance and child custody’s and All how many years is the marriage Been done and all what happened and all where does the husband live and all how much money has been taken by him u can file for maintenance and divorce under the Hindu marriage act

Sorry to hear this. Dear client you can take divorce from you husband on cruelty ground. Dear client you are not earning in that case you can claim maintenance under domestic violence act. Dear client you can also filed CAW cell complaint against your husband or ur in laws under section 498A and 406 IPC. you can file for divorce on various grounds as well as file criminal complaints against him if he troubles or hurls abuses at you. for the custody of child, various factors and the best interest of the child are seen and usually given to mother but its not a guarantee

In this regard, i advice you that there is set strategy to pursue your divorce and other claims. First you should file for the DV petition in MM court and seek of protection order on custody and residence from the court and then you should seek and fight for maintenance. Straight away if you will seek divorce then you might get the divorce but not the monetary compensation which you are entitled too. Alimony amount is 25 % his salary for 20 years. So you have to choose and make your mind as to how and for what you want to fight. Further, those money which he has received by your father can be given the name of such dowry harassment instances. Your second marriage wont come in between the litigation because every marriage is different and cannot be equated from the grounds and circumstances of the last marriage.
