Hello,

Fo the query you posted, I would suggest the following:

The factual description given by you makes cruelty, a ground for divorce, stand in your favour.

Thus for the said conduct, you may file a divorce petition before the court.

I hope that answers your query.

First of all, you have not specified that you are a Hindu or not. Assuming that you are a hindu and the marriage was solemnised as per Hindu rites and ceremonies, as per the Hindu Marriage Act you can file for divorce on the ground of cruelty. Regarding the evidences needed, that can be discussed and worked out only after seeing the allegations made by your wife in the police complaint. For further queries, plz feel free to contact.

Yes the incidents and instances you have quoted, qualify as grounds of mental cruelty being committed upon you by your wife and you can file divorce on these grounds. Evidences needed may be circumstantial as it is a matrimonial issue

You can file a divorce case on the grounds of mental cruelty against her. Evidence will include a timeline, and everything from mobile call records, texts, WhatsApp, etc. as well as hard evidence such as witnesses and documents to corroborate whatever you say.
