Can I file for a divorce if I am not attached to my wife anymore

Hello All, I am married for 3 years and have a 2 year old son, my wife is fulfilling al her family duties but we both are just doing our job as husband and wife. She has left her job to take care of our son however is not willing to work again in near future. We share no common interest and this has lead to frequent querells. Giving food and washing clothes are not mere a married life should have which is completely missing for the last 18 months and I have given up...I look for a reason to not go home and she is least bothered about that. I do not want to continue with this and want to get seperated, I do not intend to remarry but want to get out of this. Please advise.

You can mutually apply for divorce on mutual consent if your wife agrees to it. If not you can file a divorce case to prove irreconcilable differences between you two and if properly handled you will get your divorce in 6 months.

It's very differently in your case, the reason you are relaying is not much difficult, it's a matter of understanding among both. So I advice you to find a common friend or well wisher can solve your problem. If not positive then with help of same commoner, u can get consent divorce.

If you both are not interested in matrimonial life better file for divorce by mutual consent. On the other hand if you only want divorce and not your wife then you need to prove to court that there is irretrievable break down of marriage and that you both cannot stay together as husband and wife.

Hello Sir, Since there is no scope for conciliation between you and your wife, the option that you have you both can come together and file a case for divorce under Mutual Consent as section 13 B of the Hindu Marriage Act.
