After I withdrew the divorce case, wife filed transfer petition.
11-May-2025 (In Divorce Law)
I had filed divorce (contested) in karnataka in November 2024. First hearing wife did not appear. On second hearing I withdrew my divorce case back in March 2025. Now after more than a month of withdrawing the divorce case, I received a transfer petition ex-party stay from supreme Court regarding the transfer from karnataka to wife's state in North India.
My query:
1. Will wife be notified of withdrawal of my divorce case?
2. Should I go to supreme Court while I have already withdrawn my case
if your wife will check in future she will come to know about the withdrawal of case no need to go to supreme court
once the case is withdrawn by petitioner/complainant that case is closed now forthier action will be taken on that case if she want divorce or that case to reopen she has to file fresh/new case.
the divorce case, even if was not withdrawn by you would not have been transferred to the place where your wife Linted it without her lasyon bringing the order of stay and transfer by Supreme Court. Even now while the case has been withdrawn, it is for her lawyer to take action. you need not do anything.
Hello, your wife after receiving the information about divorce petition filed by you she without coming to the family court might have moved to the Supreme Court for transfer of pending divorce petition . Meanwhile you have withdrawn the case but Supreme Court didn't have information about the withdrawal of the case. So the Supreme Court have given the order for the stay of the proceeding of case in family court. In this case you have to appear in Supreme Court with certified copy of order of the case in the Bangalore .
Dear Sir,
You have done a good job by withdrawing your Divorce case. The orders passed by the Hon'ble Supreme Court will become infrustuous if the said order was passed after the date of your withdrawal. The concerned Family Court will inform either to the Supreme Court or to the concerned Family Court in North India about the withdrawal. You need not to do anything but get certified copies of such withdrawal and keep them with you.
