.If a person is caught red hand for theft of electricity under section 135 of Electricty Act 2003.How the guilty /accused can seek bail

If the person is caught red handed and is put behind bars then he has to apply for bail under section 437 CrPC. The court can ask for surety in case granted bail. And if he’s not arrested yet then he can apply for anticipatory bail also that is if he’s arrested he be released on bail. For more legal assistance I am just a call away.

Grant of bail depends on the facts of each case.
However, in general bail can be granted by the court on furnishing of surety bond.
Court may also impose condition of deposit of a percentage of alleged amount of electricity theft.
Getting bail is difficult in such matters where accused has multiple cases pending.

You can apply for bail if the FIR is registered before the Magistrate, if no FIR is registered you can contest the case in DERC and Consumer Forum. Consult a lawyer for a better advice, as this will need research and study of your case
