Section 135 of the Electricity Act, 2003 which deals with the offence of tampering with the electricity meter, is:-
Non-Bailable - As per Section 151B of the Electricity Act, 2003 an offence punishable under Section 135 of the Act shall be cognizable and non-bailable.
Compoundable - Section 152 of the Indian Electricity Act, 2003 provides for the provision for compounding of offences. This means that the Appropriate Government or any authorised officer can accept a sum of money from a consumer or person who has committed or is suspected of committing an offence related to Theft of electricity i.e, Section 135 of the Act. The amount of money that can be collected for compounding the offence is based on the nature of service, with rates specified per Kilowatt (KW)/Horse Power (HP) or per Kilo Volt Ampere (KVA) of contracted demand for High Tension (HT) or Low Tension (LT) supply.
The rates for various services are as follows:

Industrial Service - twenty thousand rupees;

Commercial Service - ten thousand rupees;

Agricultural Service - two thousand rupees;

Other Services - four thousand rupees.
This provision applies regardless of anything contained in the Code of Criminal Procedure, 1973 (2 of 1974).
